KALABURAGI — In a landmark decision, the Karnataka Information Commission (KIC), Kalaburagi Bench, has ruled that the Kalaburagi and Yadgir District Cooperative Central (DCC) Bank qualifies as a “Public Authority” under the Right to Information (RTI) Act, 2005.
The ruling, delivered by Information Commissioner B. Venkatasingh on July 30, 2026, brings the cooperative bank under the direct purview of transparency laws, making it accountable to public information requests.
Background of the Case
The case stems from an RTI application filed on January 25, 2022, by Rajakumar Aaland, who sought details regarding actions taken on a letter he wrote to the Aaland branch of the Kalaburagi-Yadgir DCC Bank.
Both the branch manager and the First Appellate Authority at the bank’s head office rejected the request, arguing that the bank does not receive substantial financial assistance from the government and therefore falls outside the scope of the RTI Act.
Dissatisfied with this stance, Aaland filed a second appeal before the KIC Kalaburagi Bench.
Key Grounds for the Ruling
While acknowledging that the bank may not receive massive direct financial aid, Commissioner Venkatasingh emphasized that its operations, rules, and directives are heavily regulated and guided by the government. The Commission based its verdict on several crucial factors:
- Government Share Capital & Leadership: The bank has received government share capital, and its Chief Executive Officer (CEO) and Managing Director (MD) are appointed by the government.
- Supersession & Disciplinary Powers: In cases of financial irregularities, the Department of Cooperation can form investigative teams and hold the power to supersede the bank’s governing board.
- Nominee Directors: The government nominates both an official and a non-official member to the bank’s board of administration.
- Subsidies and Loan Waivers: Interest on agricultural loans disbursed through NABARD is paid directly by the government, and government debt-relief schemes directly benefit the bank through direct state payouts.
- Staff Recruitment & Auditing: Staff recruitments require government approval with an official state representative present. Furthermore, NABARD and Apex Bank conduct annual inspections, submitting detailed reports to the Registrar of Cooperative Societies.
Citing a parallel precedent from the KIC Bangalore Bench (Case No. KIC 24802 APL 2024 dated February 9, 2026), the commission formally declared the DCC Bank a public authority.
Directives Issued
The Commission has directed top state officials—including the Principal Secretary of the Department of Cooperation, the Registrar of Cooperative Societies (Bengaluru), and the Joint Registrar of Cooperative Societies (Kalaburagi)—to ensure compliance. The bank must now implement Sections 4(1)(a) and 4(1)(b) of the RTI Act and officially appoint a Public Information Officer (PIO) and a First Appellate Authority (FAA).

- Overall Statistics (Nov 24, 2025 – July 31, 2026): Over this 140-day period, the bench handled 5,123 cases, resolved 2,448, levied Rs. 5.93 lakhs in fines (collecting Rs. 4.72 lakhs), and ordered Rs. 86,000 in appellant compensation.
